Introduction

This Privacy Policy shows the categories of personal data processed, the method and purposes of their collection, the conditions for the transfer and / or disclosure of personal data and your various rights and options for these purposes.

Please see our Terms and Conditions available at www.taxhouse.ro. Normally, the Website may be used without entering of any personal data.

As a rule, Taxhouse SRL collects and processes data that is freely provided by the users of Taxhouse Website or by the Taxhouse SRL’s clients.

The Privacy Policy of Taxhouse SRL applies to any Website visitor / user, and to any personal data processed by Taxhouse SRL.

If you do not want your personal data to be processed by Taxhouse SRL, please do not send any document / information that includes personal data.

Also, Taxhouse SRL processes a set of personal data collected during performance of its activities, e.g. CV data if you apply for a position in our company.

Who processes your personal data

Your personal data controller is Taxhouse SRL, with registered offices in Bucharest, 1st sector, Str. Popa Savu 79-81, 1st floor, 1st sector, recorded with the Trade Registry under no. J40/7994/2006, VAT number RO 18679070.

Categories of processed data

Taxhouse SRL collects and processes only the personal data that is provided to Taxhouse SRL by Users / visitors when accessing the Website, when applying for delivery of our products, by any available means.

The following types of personal data may be processed by Taxhouse SRL:

  • Name, company, position, e-mail, address, phone, confirmation message for filling-in the contact form;
  • If you apply for a position in our company, the personal data provided by you for the application for this position will be processed by us in order to select the proper candidates. Such data shall not be disclosed to thirds parties and it shall be used exclusively for the aforementioned purpose, safely and confidentially.

 

How taxhouse srl collects your personal data

We can collect your personal data in certain circumstances, including:

  • When you contact our company, using the e-mail or the phone number, to request information and / or details concerning our services;
  • When you provide us, in any manner, with your personal information to initiate a contractual relation with Taxhouse SRL;
  • When you submit data (CVs) for employment in a position in our organization;

 

Legal grounds for personal data processing

Any operation that represents a processing activity, as per legal provisions (e.g., without limitation, collection, storage, registration, structuring, adaptation or modification, retrieval, consultation, use, dissemination, destruction) of your personal data shall be performed based on any of the legal grounds set forth below:

  • Processing is required for the conclusion and / or performance of a contract concluded with you;
  • Processing is required for compliance with a legal obligation;
  • Processing is required for legitimate interests of Taxhouse SRL, unless your interests or fundamental rights and freedoms prevail over such interests.
  • Processing is carried out based on your previous and express consent, in case of marketing newsletters received on your e-mail address, a consent that was given upon subscription.  You may opt out from marketing newsletters at any time by sending an e-mail to gdpr@taxhouse.ro with the subject “Unsubscribe”.

 

Purposes for the processing of your personal data

We may use your personal data only for the following purposes:

  • Provision of services offered by Taxhouse SRL;
  • Compliance with legal obligations applicable to us (e.g. obligations to maintain records);
  • Analysis and improvement of our services and communications delivered to you;
  • Protection of security and management of access to our offices, to our ITC systems, to our Website and to other systems;
  • For monitoring and assessment of compliance with our policies and standards;
  • If you applied for a position in our company, the data provided is required to check whether your professional training and experience is acceptable for the desired position;
  • For any other purpose that is ancillary and / or auxiliary to any of the above or for any other purpose for which your personal data was submitted to us.

Based on your express consent, we may process your personal data also for the following purposes:

  • Communication with you, through the channels approved, to keep you updated on the activity of Taxhouse SRL, on notifications and other information concerning the activity of Taxhouse SRL, as well as on the events and projects organized by Taxhouse SRL (direct marketing).

We shall not use your personal data in taking automated decisions that may affect you or that may cause generation of other profiles except from those set forth above.

Sharing of your personal data

We may share your personal data in the following circumstances:

  • to law courts, law enforcement authorities, regulatory authorities or lawyers, or to other persons if this proves necessary for the establishment, exercise or defense of legal claims.
  • we may use aggregated personal data and statistics in order to monitor the use of Taxhouse SRL’s Website.

Also, we may share your personal data with authorized companies – represented mainly by service providers (providers of various services, e.g. Website administration and hosting services, advertising services) for the processing of personal data for the purposes shown above, in our behalf and only in compliance with our instructions. Taxhouse SRL shall maintain control on your personal data and shall take all appropriate protective measures, as per applicable law, to provide integrity and safety of your personal data when requesting the services of such providers.

Also, Taxhouse SRL reserves the right to transfer your personal data in case of reorganization and / or full or partial transfer of patrimony to third parties, in compliance with the legal provisions in force on personal data processing.

Therefore, we shall disclose your personal data only based on your instructions or permissions, when required by applicable law or regulations, or upon request of judicial or official bodies, or as required for investigation of fraudulent or criminal actions.

Your personal data shall not be disclosed to third parties or partners for direct marketing purposes.

Storage of personal data

The personal data may be stored on our or our collaborators’ IT systems.  We adopted all measures required concerning the persons handling personal data, the spaces when such data is processed and also concerning the technical equipment used for data processing, in order to provide that such data is processed in safe and confidential conditions while preventing the unauthorized access to, or loss of, data.

Updating of personal data

In case when any of the personal data that you provided incurs changes, e.g. If you change your name, surname or the e-mail address, the mailing address or if you wish to opt out of any request from Taxhouse SRL, or if you become aware that we keep inaccurate personal data, please notify us by e-mail to  gdpr@taxhouse.ro.

Period of keeping of your personal data

Taxhouse SRL implemented technical and organizational measures for organization of the process and of the criteria set forth for deletion or elimination of your personal data.
Your personal data shall be deleted or eliminated when it is no longer required for the purposes for which they were received, or when you request deletion of data based on the exercise of your “right to be forgotten”, and when Taxhouse SRL completed its legal obligation to keep such data.  However, we shall keep your personal data when it is necessary for the exercise or protection by Taxhouse SRL, in court, of any of your or another individual’s rights, until the relevant retention period or until the final settlement of such actions in court.

Unless you expressly request our company to store your personal data for longer periods or unless such personal data is required for protection, in court, of any possible right, beyond the mandatory storage period, your personal data shall be deleted within 10 years after your latest interaction with our company.

Your rights concerning the personal data processing

Subject to certain legal conditions, you have the following rights concerning the processing of your personal data:

1. The right to request from Taxhouse SRL access to such data. You have the right to acquire from Taxhouse SRL a confirmation of the processing or non-processing of your personal data and, in such case, you will acquire access to such data and to the following information: the data processed by our company, the purpose of such processing, the dissemination of data to third parties and the identity of such parties, as well as the storage period of such data.  You shall also receive a renewed information notice concerning your detailed rights related to your personal data.  You have the right to receive, free of charge, a copy your processed personal data.  We reserve the right to charge a fee for any other additional copies requested.  You may request communication of aforementioned data in electronic form, in which case data shall be provided in the electronic form currently used by our company unless you request communication of data in another format.

2. The right to request Taxhouse SRL to rectify such data. You have the right to require, without undue delay, rectification of your inaccurate personal data and / or to require additions to incomplete personal data, including through submission of an additional request.

3. The right to request Taxhouse SRL to delete such data. You have the right to request Taxhouse SRL to delete your personal data, without undue delay, and Taxhouse SRL undertakes to delete your personal data based on the following reasons:

  • The personal data is not required for accomplishment of the purposes for which it was collected or processed;
  • You exercise the right to object, in the conditions set forth for this right, and there are no prevailing conditions concerning this processing;
  • You exercise the right to object against the use of your personal data for direct marketing;
  • The personal data was processed in contradiction with the legal provisions;
  • The personal data must be erased to comply with a legal obligation of the operator based on the European or national legislation.

4. The right to request Taxhouse SRL to restrict data processing. You have the right to request Taxhouse SRL to restrict processing of your personal data, in the following conditions:

  • If you challenge the accuracy of processed data, for a period that allows us to check accuracy of data;
  • If processing is illegal and you did not exercise the right for deletion, you have the right to request restriction of data processing;
  • If the data controller does no longer need the personal data for processing purposes, however you request such data for the establishment, exercise or defense of legal claims;
  • In case when you objected to processing, during the period when verifications are made to assess whether the legitimate rights of the data controller prevail over the rights of the data subject;
  • In case you restricted the data processing, you shall be informed before such restriction is cancelled.

5. The right to object.

You shall have the right to object, on grounds relating your particular situation, at any time, to processing of your personal data.   shall no longer process the personal data unless the controller demonstrates compelling legitimate grounds for the processing which override the interests, rights and freedoms of the data subject or for the establishment, exercise or defense of legal claims.

Also, when personal data is processed for direct marketing purposes, you shall have the right to object at any time to processing of personal data, which includes profiling to the extent to which it is related to such direct marketing.

If you opposed to processing as per the above conditions, the personal data shall no longer be processed for such purposes.

6. The right to data portability.

you shall have the right to receive your personal data that you provided to us actively and in informed conditions, or monitored by us following your use of our services, and you have the right to transmit such data to another controller, being able to request submission of such data to another controller directly to another controller, if this is technically feasible.

The rights shown above may be exercised through a written request, addressed to Taxhouse SRL, at Str. Popa Savu 79-81, 1st floor, 1st sector, Bucharest, or at e-mail gdpr@taxhouse.ro.  In such case we may ask you to prove your identity by submission of copy of a valid ID document, to allow us to maintain consistency with security obligations and to prevent unauthorized disclosure of data.
We shall give due consideration to each requests or claims received, and we shall provide an answer in due time.

If you are not satisfied with our answer, you have the right to submit a claim to the National Supervisory Authority for the Processing of Personal Data.

Updates to the privacy policy

This Privacy Policy was updated in January 2021.  We reserve to update and change this Privacy Policy to reflect any changes on the method of processing of your personal data or the changes of legal requirements.  In case of any such change, we shall post on our Website the amended version of the Privacy Policy and / or we shall submit the same to you in another manner.

Confidentiality

We undertake to process your personal data in compliance with the legal provisions and in secure and confidentiality conditions.  We adopted all measures necessary both internally and with regard to our collaborators in order to provide compliance with this principle.  We request our partners to comply with the same level of Security and Confidentiality in relation to personal data.  In case when, based on your consent, we submit data to third parties, we request these third parties to comply with the legal requirements concerning the personal data processing.
